  1. I invite your kind attention to the reference cited and wish to submit that in the G.O 1st cited the Government of Andhra Pradesh have identified and declared 257 Mandals as Drought effected Mandals in Rabi 2018-19 in eight districts of the State.
  2. In the Memo 5th cited Government of AP have accorded permission to provide Mid-Day Meal to the students of Primary, Upper Primary and High schools entitled as per norms during the summer vacation of 2018-19 to the children in 257 drought affected Mandals.
  3. During the year 2017-18 the MDM was provided to the children of drought affected Mandals. As per request of the Teachers' Union necessary proposal was submitted to Government for sanction of Earned Leave to the HMs/Teachers, worked in summer holidays for MDM scheme. But, Government in its Memo No.225780/Prog.I/A1/2017, dated:27-11-2017 have nominally accepted for payment of an amount of Rs.2000/- per teacher, who worked during summer holidays, and also requested for specific Head-of-Account to meet the expenditure. The details of Head of Account was submitted to Government, but orders of Government are awaited.
  4. In this connection, it is submitted that the Head Master of High Schools and Head Teacher of Primary/ UP schools has to be present at the time of cooking and serving Mid-Day Meal scheme. The cooking may start in the morning and the serving would be completed by 2 PM. The Cook-cum-Helpers of the schools are also being paid honorarium for two months.
  5. Coming to the rule position, it is submitted that the Earned Leave shall be preserved for all those employees, who are prevented from availing summer vacation/ proportionately as per the leave rules. Further, as per Rule.82(b) of Andhra Pradesh Fundamental Rules "vacation counts as duty, but the periods of total leave in Rule 81(a) & (b) should ordinarily be reduced by one month for each year of duty in which the Government servant has availed himself of the vacation. If a part only of the vacation has been taken in any year, the period to be deducted will be a fraction of a month equal to the proportion which the part of the vacation taken bears to the full period of the vacation."
  6. Further, as per Ruling. 15 under the same rule states "if a Government Servant of the vacation department does duties during vacation and separately remunerated should not be considered as having been deprived of vacation." However, the teaching and non-teaching staff, who are prevented from availing vacation/ summer vacation for attending the duties such as preparation/ revision of electoral rolls, enumeration, census and received remuneration shall not be treated as remuneration in terms of G.O.Ms.No.35, Education, 16.01.1981 and G.O.MS.No.355, GAD, dated:19-05-1991.
  7. A Teachers' Union FAPTO, in its representation has requested for sanction of Earned Leave to all the HMs and Teachers, who are drafted for MDM scheme during summer vacation instead of remuneration.
  8. In view of the above circumstances, I request the Government to examine the request of the Teachers' Unions and accord necessary permission for sanctioning compensatory Earned Leave to the Head Masters and Teachers, who work during summer vacation under Mid-Day Meal Scheme in 257 Drought Affected Mandals or accord necessary sanction for payment of an amount of Rs.2000/- per teacher for total period of 42 days of summer vacation.
