In view of Covid-19 pandemic and subsequent lockdown, the University Grants Commission constituted an Expert Committee to deliberate and make recommendations on the issues related to the Examinations and the Academic Calendar to avoid academic loss and take appropriate measures for the future of students.
These UGC guidelines on Examinations and Academic Calendar for the Universities in View of COVID-19 Pandemic and Subsequent Lockdown were issued in presence of Union HRD Minister Shri Ramesh Pokhriyal 'Nishank' in New Delhi today. Secretary, Higher Education, MHRD Shri Amit Khare and senior officials of the Ministry and UGC were present on the occasion.

UGC Guidelines on Examinations and Academic Calendar Universities - COVID-19

The following are the main recommendations in the guidelines issued by UGC today
  • 1. Intermediate Semester Students: Will be graded based on internal assessment of the present and previous semester. In states where the COVID-19 situation has normalized, there will be exams in the month of July.
  • 2. Terminal Semester Students: exams will be held in the month of July.
  • 3. A COVID-19 cell will be constituted in every university which will be empowered to solve the issues of students related to academic calendar and examinations.
  • 4. A COVID-19 cell in the UGC to be created for faster decision making.
The highlights of the Guidelines are as under:
  • Guidelines are advisory in nature.
  • University may chart out its own plan of action taking into consideration the issues pertaining to COVID – 19 Pandemic
  • Ensure Social Distancing.

ACADEMIC CALENDAR

1. The following calendar is suggested for the academic session 2019-2020:
The Academic Calendar is suggestive in nature. The universities may adopt / adapt it after making a comprehensive assessment of their level of preparedness, residential status of the students, status of COVID-19 pandemic spread in their city / region / state and other factors.

  • # - If situation so demands, the universities can have Summer Vacations for 30 days from 01-06-2020 to 30-06-2020. In that case the teaching-learning through various modes can be held up to 15-05-2020 and subsequently Finalization of Dissertation etc. may be completed from 16-05-2020 to 31-05-2020.
  • 2. The universities should develop a fool-proof plan before the resumption of session, strictly following the norms of “social distancing” and other required precautions, to avoid any eventuality arising due to COVID-19.
  • 3. Admissions to the UG and PG programmes for the session 2020-21 may be completed by 31.08.2020. If necessity arises, provisional admissions may also be made and relevant documents of qualifying examination may be accepted up to 30.09.2020.

4. The Academic Session 2020-21 may commence from 01.8.2020 for old students and from 01.09.2020 for fresh students. The following calendar is suggested for the academic session 2020-2021:

EXAMINATIONS
  • Universities may adopt alternative and simplified modes and methods of examinations to complete the process in shorter period of time .
  • Universities may adopt efficient and innovative modes of examinations by reducing the time from 3 hours to 2 hours.
  • Universities may conduct Terminal / Intermediate Semester / Year examinations in offline / online mode, as per their Ordinances/Rules and Regulations, Scheme of Examinations, observing the guidelines of “social distancing” and keeping in view the support system available with them and ensuring fair opportunity to all students.
  • Terminal semester/ year examinations for PG/ UG courses/ programmes may be conducted by universities as suggested in the academic calendar. The timing of the examination may be considered appropriately by the universities, and examination may be conducted keeping in mind the guidelines of “social distancing”.
  • For intermediate semester/year students, the universities may conduct examinations,after making a comprehensive assessment of their level of preparedness, residential status of the students, status of COVID-19 pandemic spread in different regions / state and other factors.
  • In case the situation does not appear to be normal in view of COVID-19, in order to maintain “social distancing”, safety and health of the students, grading of the students could be composite of 50% marks on the basis of the pattern of internal evaluation adopted by the universities and the remaining 50% marks can be awarded on the basis of performance in previous semester only (if available). The internal evaluation can be continuous evaluation, prelims, mid-semester, internal evaluation or whatever name is given for student progression.
  • In the situations where previous semester or previous year marks are not available, particularly in the first year of annual pattern of examinations, 100% evaluation may be done on the basis of internal assessments.
  • If the student wishes to improve the grades, he/she may appear in special exams for such subjects during next semester.
  • This provision for intermediate semester examinations is only for the current academic session (2019-20) in view of COVID-19 pandemic, while maintaining safety and health of all the stakeholders and sanctity and quality of examinations.
  • Period of lockdown may be treated as ‘deemed to be attended’ by all the students/ research scholars.
  • Adopt appropriate strategies to facilitate the UG/ PG students pursuing Projects/ Dissertations. Universities may consider to assign review-based/ secondary data-based projects or software-driven projects, instead of laboratory-based experiments or field/ survey-based assignments to these students.
  • The universities may conduct the practical examinations and Viva-Voce Examinations through Skype or other meeting apps, and in case of intermediate semesters, the practical examinations may be conducted during the ensuing semesters.
  • The universities may conduct the Ph.D. and M. Phil. Viva -Voce Examinations through Video Conferencing using Google, Skype, Microsoft Technologies or any other reliable and mutually convenient technology.
  • Extension of six months period to the M.Phil.or Ph.D. students.
  • Every University shall establish a cell for handling student grievances related to examinations and academic activities during COVID-19 pandemic and notify effectively to the students.
  • The UGC will establish a Help Line for monitoring student grievances related to examinations and academic activities during COVID-19 pandemic
3. Modes of Examinations
  • Like the modes of teaching-learning, most of the universities follow the physical mode of examinations, with a few exceptions. On this aspect also, some of the universities lack adequate IT infrastructure for conducting online examinations. The hiring of private agencies for conducting online examinations also does not seem feasible in view of the fact that examinations are to be conducted simultaneously by all the universities. Therefore, keeping in view the basic infrastructure available at the level of the institutions and accessibility of internet to the students, especially in remote areas, it is not feasible to uniformly adopt the online mode of examination at this juncture.
4. Academic Calendar for the Session 2020-21
  • Several School Boards are yet to complete their Class XII Examinations, as of now. Examinations for the Even Semester in the universities are also getting delayed due to national lockdown. Naturally, all these things will delay the admission process in the university system for the next academic session. In order to tackle this situation, the universities may require some amendments in their academic calendar for the academic session 2020-21.

It has been brought to the notice of Commissioner of School Education, A.P stated that certain teachers have been working as APOs, ASOs, for the last 10-15 years in the olo DEOs. As per FR (18) (1) maximum period for deputation of any employee is 5 years. As per RTE 2009 rule (27), the services of teachers should not be utilized for non-teaching work.
  • In this circumstance, there is a dire need to take action regarding continuing the services of teachers as ASOS, APOs, in IT Cell & Bio Metric attendance purpose in Olo. District Educational Officer and in Olo. District Common Examination Board (DCEB)
  • In view of the above, all the District Educational Officers in the state are requested to follow the instructions given below.
  • a. Relieve the teachers who are working as ASOS, APOs in the Olo. District Educational Office, & teachers, working in IT Cell work & Bio Metric attendance in Olo. District Educational Office and in Olo. District Common Examination Board (DCEB) before reopening of the schools with instructions to them to join in their respective Schools. If there is no vacancy in their previous station, allot them to needy schools where there is a vacancy.
  • b. Utilize the services of members of Divisional Level Monitoring Teams (DLMTs) and competent Cluster Resource Persons (CRPs) as ASOS, APOs. 
  • c. Explore/suggest the possibilities to fill up the gap occurred due to relieving of ASOS/APOs if any.
  • The receipt of these proceedings should be acknowledged.

Details of the Clariications:
In continuation to the orders issued vide reference 1st to 6th cited, the following further instructions and clarifications are issued.
  • (1) No deduction of one day basic pay from the employees will be effected during this month, as stated vide reference 5th cited. The same will be effected at a later date from the deferred amount, as and when, orders are issued for payment of the same.
  • (2) Recovery of CPS/NPS employee share shall be effected from the class-IV employees and others for whom 10% deferment is allowed(other than contract/ outsourcing).
  • (3) Vide reference 4th cited, the Hon’ble High Court has issued orders for voluntary contributions to be made towards CM Relief fund for COVID-19 Prevention from its employees, basing on the cadres, both for judicial and non-Judicial officers and staff. Accordingly, most of the Judicial and Non-Judicial officers have contributed the amount to CM Relief Fund. Hence, no recovery of one day basic pay shall be effected from the pay bill of Judicial department for April-2020.
  • (4) Government has also taken a decision to pay full salaries to few departments like Police and Medical vide reference 3rd cited, hence, one day basic pay may be deducted from the employees of these departments from the current month (April 2020 payable in May 2020) pay bill.
  • Necessary changes have already been made in the HRMS/CFMS programming and the provision is already enabled to the DDO’s for presentation of salary bills for the month of April-2020.

ORDER:
  1. In the wake of outbreak & rapid spread of COVID-19, the Government of Andhra Pradesh had initially imposed lockdown till 14th April, 2020 vide the reference third cited under the Disaster Management Act, 2005 as per the guidelines issued by the Ministry of Home Affairs, Government of India for the containment of the COVID-19 pandemic & has further extended the lockdown till 3rd May, 2020 in line with the decision of Government of India in order to contain the spread of the disease. 
  2. 2. The Government, have issued orders vide the references fourth and sixth, read with the reference fifth cited, for the deferment of the payment of Salaries/Wages/ Remuneration/Honorarium/Pensions until further orders, in view of the circumstances stated in detail in the said order.
  3. 3. Since the circumstances prevailing since the issuance of the orders in the references fourth, fifth & sixth cited, have not materially altered, the Government hereby order that the deferred payment of Salaries/Wages/Remuneration/ Honorarium, as per the pattern prescribed in reference fourth, fifth & sixth cited above, shall continue for the month of April 2020 payable in May 2020.
  4. 4. Further, the Government, after having considered the hardships being faced by the pensioners, hereby order for the payment of full pensions to all the categories of pensioners, as per the usual scale & procedure.
  5. 5. The DTA/PAO/DWA and all the Drawing & Disbursing Officers shall ensure that the above order is implemented, without any deviation.
  6. 6. The CEO, CFMS, A.P. Ibrahimpatnam is requested to take necessary action in the matter.

  • In the references first, second and third read above, the President, Andhra Pradesh Secretariat Association, the Chairman, JAC of Employees, Teachers, Workers and Pensioners, Andhra Pradesh and the Chairman Andhra Pradesh JAC, Amaravati have expressed their willingness to share the responsibility and to cooperate with the Government for controlling the COVID-19 pandemic by contributing their one day basic pay to Chief Minister’s Relief Fund.
  • 2. Government, after careful consideration hereby orders for deduction of one day basic pay of employees and pensioners of State Government and remit the same to the Chief Ministers Relief Fund for providing financial assistance to the poor people most affected by the lockdown. 3. All the Drawing and Disbursing Officers of Secretariat Departments/ all Drawing and Disbursing Officers of all the Heads of the Departments and Registrars of all Universities concerned shall ensure that the correct deductions are made from the pay bills of April, 2020 payable in the month of May, 2020 without fail and remit the same to the Chief Minister's Relief Fund for relief of poor people most affected by the lockdown.
  • 4. The Director of Treasuries and Accounts/Pay and Accounts Officer/Director of Works Accounts and all the Drawing & Disbursing Officers in the State shall ensure that the above order is implemented, without any deviation and inform the same to the Special Chief Secretary to Government, Revenue (CMRF) Department, Andhra Pradesh.

ORDER
  • While communicating a copy of the Government Order in the reference cited, all the District Collectors in the state hereby requested to ascertain the choice from Parent / Guardian of the students who studied from Class 1 to 5 during academic year 2019-20 and who are going to join Class 2nd to 6th during 2020-21 with regard to the medium of instruction in which they would like their children to pursue their Education in the coming academic year 2020-21 in classes II to VI.
  • 2. The choice shall be obtained by the District Education Officers through Mandal Educational Officers in the model option form enclosed herewith who would in turn circulate the formats to the parents through Village Secretariats.
  • 3. For this purpose, they shall direct the District Education Officers to communicate the mandal wise, village wise and school wise lists of children along with their parent details as per the mapping already done for implementation of Ammavodi program. The lists shall be communicated in excel sheets along with option forms as annexed to this order. The cost of printing of option forms shall be met under the DPO cost of Samagra Shiksha for the year 2020-21.
  • 4. The choice of the parents/ Guardian shall be obtained through Village/Ward Secretariats following the protocols prescribed for COVID-19 with due precautions and safety measures. They are further requested to collect the signed hard copies of option forms school wise, mandal wise and keep the hard copies in the Office of the District Educational Officer for record purpose.

ORDER:
  • In the G.O 1st read above, orders were issued for conversion of all classes from I to VI in Primary, Upper Primary, High Schools under all managements into English Medium from the academic year 2020-21 and gradually increasing each further class from the next consequent academic years.
  • 2. In the G.O. 2nd read above, orders were issued to implement the Telugu as compulsory subject in all schools under all managements both Government and Private in the State.
  • 3. In the G.O. 3rd read above, orders were issued to continue one school for Telugu Medium at Mandal Headquarters and to continue all minor medium schools in all managements except unaided schools in the State.
  • 4. Whereas, two WPs ( PIL) i.e., 183 & 185 of 2019 have been filed in the Hon’ble High Court with a prayer to set aside the orders issued by the Government vide G.O.Ms.No.81, School Education ( Prog.I) Department, dated 05.11.2019 and G.O.Ms.No.85, School Education ( Prog.I) Department, dated 20.11.2019.
  • 5. The Hon’ble High Court in WPs (PIL) 183 & 185 of 2019, delivered its judgement holding that the said G.Os are found not in conformity with the law, inter alia on the ground that the said G.O. has the effect of forcing the students’ choice without reference to his/her right to choose and the Hon’ble High Court has also found that the procedure contemplated under the RTE Act, 2009 has not been followed. 
  • 6. While holding so, the Hon’ble High court negatived the following contention of the State. The contention of the State government was that, as part of “Amma Vodi Varotsavam” held between 04.01.2020 to 09.01.2020, the Parent Committees (Earlier known as School Management Committees) all over the State have met on 07.01.2020 and debated with regard to introducing English as a medium of instruction in the Government schools from Class I to VI from the academic year 2020-21 and communicated their resolutions to the O/o Commissioner of School Education through District Education Officers in the State. The Commissioner of School Education has informed that the resolutions have been tabulated and found that 93.77% of the Parents committees have passed resolutions requesting for introduction of English medium in Government schools and 1.38% for Telugu Medium and 4.34% for both English and Telugu medium 0.46% for other media.
  • 7. The Commissioner of School Education has further informed that the Hon’ble High Court of Andhra Pradesh vide reference 4th read above observed in Para 71 of judgment, that a child or on his behalf his parent or guardian, has a right to freedom of choice with regard to the medium of instruction in which he would like to be educated at primary stage in the school and not the school Monitoring Committee or Parents Associations, and further stated that the Hon’ble High Court has observed in para 53 of their judgment that the Universal Declaration of Human Rights to which India is a signatory, may have its significance wherein at Article 26 (3) it was specifically mentioned that the parents have a right to choose the kind of education that shall be given to the children.
  • 8. Therefore, the Commissioner of School Education vide reference 5th read above has requested to accord permission to ascertain the choice from the Parent/Guardian of every student who studied Class I to V during the academic year 2019-20, as to which medium of instruction they would like their children to pursue in the coming academic year 2020-21 in order to take necessary action in this regard. He has also submitted a model format for ascertaining the option of the Parents / Guardians. He further proposed that the District Educational Officers and Mandal Educational Officers shall be directed to obtain the parental choice through the field functionaries of the Village / Ward Secretariats as the Educational Institutions are closed at present.
  • 9. After careful examination of the proposal, Government hereby accord permission to the Commissioner of School Education to ascertain the choice from Parent / Guardian of the students who studied from Class I to V during the academic year 2019-20 with respect to the medium of instruction in which they would like their children to pursue their Education in the coming academic year 2020-21. The choice shall be obtained through District Education Officers and Mandal Education Officers who would in turn circulate the formats to the parents through Village Secretariats in the State. He is further requested to furnish consolidated reports to the Government after obtaining the choice of the parents for taking further action in this regard.
  • 10. The District Collectors are directed to issue necessary instructions to the Village and Ward Secretariats to collect choice of the parents/guardian following the protocols prescribed for COVID-19 with due precautions and safety measures.
  • 11. The Commissioner of School Education, A.P. shall take necessary action in the matter, accordingly.

Details:
  • It has come to the notice of the Government that, some Gram Volunteers and Ward Volunteers vacancies arose due to unauthorised absence, irregular in attending duties and some have resigned their job during the crisis of outbreak of Covid-19. Government also noticed that, as the role of the Village/Ward Volunteers in delivering the services to the door steps of Households is crucial, there is an immediate need to fill up the vacancies arose due to resignation and for other reasons.
  • 2. In the reference 1st to 4th cited, Government have issued guidelines for filling up of the vacancies of Village/Ward Volunteers duly mentioning the time lines, eligibility criteria viz., age, qualification, reservation etc.,
  • 3. The Government have examined the matter and decided to fill up the vacancies of Village/Ward Volunteers in all Villages/ULBs of the State by issuing the following guidelines for positioning of Village/Ward Volunteers in 3rd Phase in modification of earlier guidelines.
a) NOTIFICATION:
The Notification shall be issued in Telugu language by the MPDOs in respect of Rural areas and Municipal Commissioners in respect of Urban Areas and shall be published in the respective Village/Ward Secretariats for vide publicity, wherever the vacancies are available in the existing clusters of the respective Village/Ward Secretariat jurisdiction.

b) NUMBER OF VACANCIES OF VOLUNTEERS:

  • The number of vacancies of Volunteers shall be arrived by the concerned MPDOs/Municipal Commissioners as per clusters/territorial units, which are in functional existence after due consideration of the vacancies arisen, if any due to resignation or other reasons. Volunteers, who are on leave because of maternity and other health grounds may not be considered as vacancies. Further, while arriving at number of vacancies, MPDOs/MCs shall ensure that the volunteers do not exceed the existing cluster/Territorial Units. And, if any duplicate or redundant cluster/Territorial Units are in existence in the data base, same should not be taken into consideration for arriving at vacancies. Any request for adding new cluster to any Secretariat shall be considered on the case to case basis at State Headquarters following the same in rationale basis.
c) AGE:
The applicant shall be of at least 18 years of age as on 01.01.2020 and shall have not exceeded 35 years.

d) HOW TO APPLY:

e) RESERVATION:
The Rule of reservation is applicable as per the rules in vogue. 50% of posts within each category may be considered for women. ROR will be applicable considering ULB area as a unit. In case, no candidates of a particular category are available in the ULB, District may be taken as the unit.
In case of rural areas rule of reservation is applicable as per the rules in vogue. 50% of posts within each category will be considered for women. Wherever vacancies arised due to non-availability of certain communities those vacancies may be filled with other available communities. First, Mandal should be taken as the unit for fixing RoR. In case, no candidates of a particular category are available in the Mandal, District may be taken as the unit. But, in the scheduled tribal areas only ST candidates shall be appointed. In case, in a particular village in the scheduled area no eligible ST candidate is available, the same may be appointed from the adjacent village.

f) METHOD OF SELECTION:
In case of Panchayats:
All eligible applicants shall be called for interview by the Selection Committee consisting of MPDO/ Tahsildar / EO (PR&RD). The letter of engaging the services of selected Village Volunteers will be issued by the Chairman of the Selection Committee, i.e., the MPDOs

In case of Urban Local Bodies: 
All eligible applicants shall be called for interview by the Selection Committee consisting of Municipal Commissioner, Tahasildar and PO / TMC, MEPMA. The letter of engaging the services of selected Ward Volunteers will be issued by the Chairman of the Selection Committee, i.e., the Municipal Commissioner.

g) SELECTION CRITERIA:

The interview board will select the most eligible applicants based on the following four parameters:
  • 1. Should have knowledge on various Government Schemes, Programs, welfare activities - 25 Marks
  • 2. Previous work experience on various Government Welfare Departments and programs/ NGOs/Federations/Social activities - 25 Marks
  • 3. Leadership qualities, good communication skills and general awareness – 25 Marks
  • 4. Soft Skills - 25 Marks
  • Each of the four parameters will carry 25 marks each totaling to 100 marks. 
h) POSITIONING:
Positioning and Commencement of work by newly placed Village/Ward Volunteers in the villages shall start from 1st May, 2020 onwards.

ORDER:
  • In the G.Os 2nd and 5th read above, the Government of Andhra Pradesh have directed District Collectors, Joint Collectors, Police Commissioners, SPs, DM&HOs, Municipal Commissioners, Sub-Collectors, RDOs, MROs and MPDOs to take effective measures to prevent the spread of COVID-19 in the State.
  • 2. In the references 1st,, 3rd , 4th , 6th, 7th and 8th read above, the Ministry of Home Affairs, GOI have issued various orders and addendums along with consolidated Guidelines to implement “Lockdown” measures, to contain spread of COVID-19 for a period of 21 days with effect from 25.03.2020.
  • 3. Whereas, the Ministry of Home Affairs, GOI in its Order vide reference 9th read above has issued directions to all the Ministries/Departments of Government of India, State/Union Territory Governments and State/Union Territory Authorities that the “Lockdown” measures stipulated in aforesaid consolidated Guidelines of MHA for containment of COVID-19 epidemic in the Country, will continue to remain inforce upto 03.05.2020 to contain the spread of COVID-19 in the Country.
  • 4. Therefore, all the District Collectors, Joint Collectors, Police Commissioners, Superintendents of Police, DM&HOs, Municipal Commissioners, Sub-Collectors, RDOs, MROs and MPDOs are hereby instructed to strictly implement the Order mentioned vide reference 9th read above in accordance with the Guidelines Annexed to this G.O. For implementing the containment measures, the District Magistrate will deploy Executive Magistrates as Incident Commanders as specified in the Annexure.
  • 5. The Order mentioned vide reference 9th read above shall be implemented along with various orders issued from time to time by the State Government for “Lockdown” in the State for containing the spread of COVID-19.

ANNEXURE TO G.O.Rt. No. 238, HM&FW(B2) Department, Dt.14.04.2020

Consolidated Guidelines on the measures to be taken by Ministries/ Departments of Government of India, State/Union Territory Governments and State/ Union Territory Authorities for containment of COVID-19

Epidemic in the Country, as Notified by Ministry of Home Affairs Order No. 40-3/2020-DM-I(A), dated 24.03.2020 and further modified on 25.03.2020, 27.03.2020, 02.04.2020, 03.04.2020 and 10.04.2020.

1. Offices of the Government of India, its Autonomous/ Subordinate Offices and Public Corporations shall remain closed.
Exceptions:
  • a) Defence, central armed police forces.
  • b) Treasury (including, Pay & Accounts Offices, Financial Advisers and field offices of the Controller General of Accounts, with bare minimum staff),
  • c) Public utilities (including petroleum, CNG, LPG, PNG), power generation and transmission units, post offices.
  • d) Disaster management and Early Warning Agencies e) National Informatics Centre.
  • f) Customs clearance at ports/airports/land border, GSTN; and MCA 21 Registry with bare minimum staff.
  • g) Reserve Bank of India and RBI regulated financial markets and entities like NPCI, CCIL, payment system operators and standalone primary dealers with bare minimum staff.
2. Offices of the State/ Union Territory Governments, their Autonomous Bodies, Corporations, etc. shad remain closed.
Exceptions:
  • a) Police, home guards, civil defence, fire and emergency services, disaster management, and prisons.
  • b) District administration and Treasury (including field offices of the Accountant General with bare minimum staff)
  • c) Electricity, water, sanitation.
  • d) Municipal bodies- Only staff required for essential services like sanitation, personnel related to water supply etc.
  • e) Resident Commissioner of States, in New Delhi with bare minimum staff, for coordinating Covid-19 related activities and internal kitchens operations.
  • f) Forest offices: Staff/ workers required to operate and maintain zoo, nurseries, wildlife, fire fighting in forests, watering plantations, patrolling and their necessary transport movement.
  • g) Social Welfare Department, with bare minimum staff, for operations of Homes for children/ disables/ senior citizens/ destitute/ women /widows; Observation homes; pensions.
  • h) Agencies engaged in procurement of agriculture products, including MSP operations.
  • i) `Mandis' operated by the Agriculture Produce Market Committee or as notified by the State Government.
The above offices (SI. No 1 & 2) should work with minimum number of employees. All other offices may continue to work-from-home only.

3. Hospitals, Veterinary Hospitals and all related medical establishments, including their manufacturing and distribution units, both in public and private sector, such as dispensaries, chemist, Pharmacies (including Jan Aushadhi Kendra) and medical equipment shops, laboratories, Pharmaceutical research labs, clinics, nursing homes, ambulance etc. will continue to remain functional. The transportation for all medical personnel, nurses, para-medical staff, other hospital support services be permitted.

4. Commercial and private establishments shall be closed down.
Exceptions:
  • a) Shops, including ration shops (under PDS), dealing with food, groceries, fruits and vegetables, dairy and milk booths, meat and fish, animal fodder, fertilizers, seeds and pesticides. However, district authorities may encourage and facilitate home delivery to minimize the movement of individuals outside their homes.
  • b) Banks, insurance offices, and ATMs including IT vendors for banking operations; Banking Correspondent and ATM operation and cash management agencies.
  • c) Print and electronic media.
  • d) Telecommunications, internet services, broadcasting and cable services. IT and IT enabled Services only (for essential services) and as far as possible to work from home.
  • e) Delivery of all essential goods including food, pharmaceuticals, medical equipment through E-commerce.
  • f) Petrol pumps, LPG, Petroleum and gas retail and storage outlets.
  • g) Power generation, transmission and distribution units and services.
  • h) Capital and debt market services as notified by the Securities and Exchange Board of India.
  • i) Cold storage and warehousing services. j) Private security services.
  • k) Data and call centers for Government activities only.
  • l) Farming operations by farmers and farm workers in the field. m) 'Custom Hiring Centres (CHC)' related to farm machinery.
  • n) Shops of agriculture machinery, its spare parts (including its supply chain) and repairs to remain open.
  • o) Shops for truck repairs on highways, preferably at fuel pumps.
  • p) Operations of the fishing (marine)/aquaculture industry, including feeding & maintenance; hatcheries, feed plants, commercial aquaria, movement of fish/shrimp and fish products, fish seed/feed and workers for all these activities.
  • All other establishments may work-from-home only. 
5. Industrial Establishments will remain closed.
Exceptions:
  • a) Manufacturing units of essential goods, including drugs, pharmaceutical, medical devices, their raw materials & intermediates
  • b) Production units, which require continuous permission from the State Government.
  • c) Coal and mineral production, transport pharmaceutical, after obtaining required supply of explosives and activities incidental to mining operations.
  • d) Manufacturing units of packaging material for food items, drugs, pharmaceutical and medical devices.
  • e) Manufacturing and packaging units of Fertilizers, Pesticides and Seeds. f) Tea industry, including plantation with maximum of 50% workers.
6. All transport services — Air, Rail, Roadways — will remain suspended.
Exceptions:
  • a) Transportation for essential goods only.
  • b) Fire, law and order and emergency services.
  • c) Operations of Railways, Airports and Seaports for cargo movement, relief and evacuation and their related operational organisations.
  • d) Inter-state movement of goods/ cargo for inland and exports.
  • e) Cross land border movement of essential goods including petroleum products and LPG, food products, medical supplies.
  • f) Intra and inter-state movement of harvesting and sowing related machines like combined harvester and other agriculture/horticulture implements.
  • g) Transit arrangements for foreign national(s) in India. (as per attached SOP)
7. Hospitality Services to remain suspended
Exceptions:
  • a) Hotels, home stays, lodges and motels, which are accommodating tourists and persons stranded due to lockdown, medical and emergency staff, air and sea crew.
  • b) Establishments used/ earmarked for quarantine facilities.
8. All Educational, Training, Research, Coaching Institutions etc. shall remain closed.

9. All places of worship shall be closed for public. No religious congregations will be permitted, without any exception.

10. All social/ political/ sports/ entertainment/ academic/ cultural/ religious functions / gatherings shall be barred.

11. In case of funerals, congregation of not more than twenty persons will be permitted.

12. All persons who have arrived into India after 15.02.2020 and all such persons who have been directed by health care personnel to remain under strict home / institutional quarantine for a period as decided by local Health Authorities, failing which they will be liable to legal action under Sec. 188 of the IPC.
Exceptions:
  • a) Release of quarantined persons, who have arrived in India after 15.2.2020, after expiry of their quarantine period and being tested Covid- 19 negative (as per attached SOP).
13. Wherever exceptions to above containment measures have been allowed, the organisations/employers must ensure necessary precautions against COV1D-19 virus, as well as social distance measures, as advised by the Health Department from time to time.

14. In order to implement these containment measures, the District Magistrate will deploy Executive Magistrates as Incident Commanders in the respective local jurisdictions. The Incident Commander will be responsible for the overall implementation of these measures in their respective jurisdictions. All other line department officials in the specified area will work under the directions of such incident commander. The Incident Commander will issue passes for enabling essential movements as explained.

15. All enforcing authorities to note that these strict restrictions fundamentally relate to movement of people, but not to that of essential goods.

16. The Incident Commanders will in particular ensure that all efforts for mobilization of resources, workers and material for augmentation and expansion of hospital infrastructure shall continue without any hindrance.

17. Any person violating these containment measures will be liable to be proceeded against as per the provisions of Section 51 to 60 of the Disaster Management Act, 2005, besides legal action under Sec. 188 of the IPC.

Note: As specified in the lockdown measures, social distancing and proper hygiene practices must be ensured in each of the above activities. It will be the responsibility of the head of the organisation/establishment to ensure compliance of such norms. The district authorities will ensure strict enforcement.

STANDARD OPERATING PROCEDURE (SOP) FOR TRANSIT ARRANGEMENTS FOR FOREIGN NATIONALS STRANDED IN INDIA

Sub-Clause (g) in exception to Clause 6 It has been brought to the notice of this Ministry that a number of foreign nationals are stranded in different parts of the country, due to the lockdown measures. Some foreign countries have approached Government of India for evacuation of their nationals to their countries.
  • 2. In view of the above, it has now been decided that requests received from foreign governments, for evacuation of their nationals from India, would be examined by the Ministry of External Affairs (MEA), Government of India on case to case basis. In cases where such requests are endorsed by MEA, the following protocol would be observed:
  • i) The chartered flight would be arranged by the concerned foreign government in consultation with the Ministry of Civil Aviation, Government of India.
  • ii) Prior to departure, the foreign national(s) would be screened for COVID-19 symptoms as per the standard health protocol. Only those foreign national(s) would be allowed to leave, who are asymptomatic for COVID-19. In case of symptomatic person(s), the future course of treatment would be followed, as per the standard health protocol.
  • iii) The local transportation arrangements from the place of stay of the foreign national(s) to the point of embarkation would be arranged by the local Embassy/Consulate of the respective foreign government.
  • iv) The transit pass for movement of the vehicle deployed for movement of the foreign national(s) would be issued by the Government of the State/Union Territory where the foreign national(s) is/are staying.
  • v) The transit pass, as issued above, would be honoured/ allowed by the authorities of the State/Union Territories along the transit route.

STANDARD OPERATING PROCEDURE FOR RELEASE OF QUARANTINED PERSONS, AFTER EXPIRY OF QUARANTINE PERIOD AND TESTED COVID-19

NEGATIVE Sub-Clause (A) in exception to Clause 12
With a view to preventing spread of COVID-19 and as a measure of abundant precaution, persons returning from foreign locations after 15.2.2020 had been quarantined in government/government-arranged facilities. In respect of these persons, the following protocol would be observed after completion of the specified mandatory quarantine period:
  • i) Person(s) testing negative for COVID-19, and as per standard health protocol, would be released from the said quarantine facility(ies). However, this will not apply to a group, where even one person tests positive for COVID-19.
  • ii) These persons are expected to return to their homes, or to the homes of their families/relatives/friends or to other places of shelter like hotels, etc., by making their own transport arrangements.
  • iii) The transit pass for movement of vehicle(s), being used by such person(s), would be issued by the Government of the State/Union Territory where they have been quarantined.
  • iv) The transit pass will be issued for fixed route and with specified validity and such person(s) shall follow the same.
  • v) The transit pass, as issued above, would be honoured/ allowed by the authorities of the State/Union Territories along the transit route.
  • vi) As a measure of abundant caution, upon returning to their destination such persons would home quarantine themselves for a further period of 14 days as per standard protocol on the matter.
  • vii) Details of person(s) released from quarantine, along with their destination, will be shared with the concerned State/UT Government for necessary follow up.

OFFENCES AND PENALTIES FOR VIOLATION OF LOCKDOWN MEASURE.

A. SECTION 51 TO 60 OF THE DISASTER MANAGEMENT ACT, 2005
  • 51. Punishment for obstruction, etc.—Whoever, without reasonable cause 
  • (a) obstructs any officer or employee of the Central Government or the State Government, or a person authorised by the National Authority or State Authority or District Authority in the discharge of his functions under this Act; or
  • (b) refuses to comply with any direction given by or on behalf of the Central Government or the State Government or the National Executive Committee or the State Executive Committee or the District Authority under this Act, shall on conviction be punishable with imprisonment for a term which may extend to one year or with fine, or with both, and if such obstruction or refusal to comply with directions results in loss of lives or imminent danger thereof, shall on conviction be punishable with imprisonment for a term which may extend to two years.
  • 52. Punishment for false claim. — Whoever knowingly makes a claim which he knows or has reason to believe to be false for obtaining any relief, assistance, repair, reconstruction or other benefits consequent to disaster from any officer of the Central Government, the State Government, the National Authority, the State Authority or the District Authority, shall, on conviction be punishable with imprisonment for a term which may extend to two years, and also with fine.
  • 53. Punishment for misappropriation of money or materials, etc.— Whoever, being entrusted with any money or materials, or otherwise being, in custody of, or dominion over, any money or goods, meant for providing relief in any threatening disaster situation or disaster, misappropriates or appropriates for his own use or disposes of such money or materials or any part thereof or willfully compels any other person so to do, shall on conviction be punishable with imprisonment for a term which may extend to two years, and also with fine.
  • 54. Punishment for false warning.— Whoever makes or circulates a false alarm or warning as to disaster or its severity or magnitude, leading to panic, shall on conviction, be punishable with imprisonment which may extend to one year or with fine.
  • 55. Offences by Departments of the Government.— (1) Where an offence under this Act has been committed by any Department of the Government, the head of the Department shall be deemed to be guilty of the offence and shall be liable to be proceeded against and punished accordingly unless he proves that the offence was committed without his knowledge or that he exercised all due diligence to prevent the commission of such offence. 
  • (2) Notwithstanding anything contained in sub-section (1), where an offence under this Act has been committed by a Department of the Government and it is proved that the offence has been committed with the consent or connivance of, or is attributable to any neglect on the part of, any officer, other than the head of the Department, such officer shall be deemed to be guilty of that offence and shall be liable to be proceeded against and punished accordingly.
  • 56. Failure of officer in duty or his connivance at the contravention of the provisions of this Act.—Any officer, on whom any duty has been imposed by or under this Act and who ceases or refuses to perform or withdraws himself from the duties of his office shall, unless he has obtained the express written permission of his official superior or has other lawful excuse for so doing, be punishable with imprisonment for a term which may extend to one year or with fine.
  • 57. Penalty for contravention of any order regarding requisitioning.— If any person contravenes any order made under section 65, he shall be punishable with imprisonment for a term which may extend to one year or with fine or with both. 
  • 58. Offence by companies.— (1) Where an offence under this Act has been committed by a company or body corporate, every person who at the time the offence was committed, was in charge of, and was responsible to, the company, for the conduct of the business of the company, as well as the company, 25 shall be deemed to be guilty of the contravention and shall be liable to be proceeded against and punished accordingly: Provided that nothing in this sub- section shall render any such person liable to any punishment provided in this Act, if he proves that the offence was committed without his knowledge or that he exercised due diligence to prevent the commission of such offence. (2) Notwithstanding anything contained in sub-section (1), where an offence under this Act has been committed by a company, and it is proved that the offence was committed with the consent or connivance of or is attributable to any neglect on the part of any director, manager, secretary or other officer of the company, such director, manager, secretary or other officer shall also, be deemed to be guilty of that offence and shall be liable to be proceeded against and punished accordingly.
Explanation.—For the purpose of this section— (a) "company" means anybody corporate and includes a firm or other association of individuals; and (b) "director", in relation to a firm, means a partner in the firm.

59. Previous sanction for prosecution.—No prosecution for offence punishable under sections 55 and 56 shall be instituted except with the previous sanction of the Central Government or the State Government, as the case maybe, or of any officer authorised in this behalf, by general or special order, by such Government.

60. Cognizance of offences.—No court shall take cognizance of an offence under this Act except on a complaint made by— (a) the National Authority, the State Authority, the Central Government, the State Government, the District Authority or any other authority or officer authorised in this behalf by that  Authority or Government, as the case may be; or (b) any person who has given notice of not less than thirty days in the manner prescribed, of the alleged offence and his intention to make a complaint to the National Authority, the State Authority, the Central Government, the State Government, the District Authority or any other authority or officer authorised as aforesaid.

B. Section 188 in the Indian Penal Code.

  • 188. Disobedience to order duly promulgated by public servant —Whoever, knowing that, by an order promulgated by a public servant lawfully empowered to promulgate such order, he is directed to abstain from a certain act, or to take certain order with certain property in his possession or under his management, disobeys such direction, shall, if such disobedience causes or tends to cause obstruction, annoyance or injury, or risk of obstruction, annoyance or injury, to any person lawfully employed, be punished with simple imprisonment for a term which may extend to one month or with fine which may extend to two hundred rupees, or with both; and if such disobedience causes or trends to cause danger to human life, health or safety, or causes or tends to cause a riot or affray, shall be punished with imprisonment of either description for a term which may extend to six months, or with fine which may extend to one thousand rupees, or with both.
Explanation.—it is not necessary that the offender should intend to produce harm, or contemplate his disobedience as likely to produce harm. It is sufficient that he knows of the order which he disobeys, and that his disobedience produces, or is likely to produce, harm.

  • An order is promulgated by a public servant lawfully empowered to promulgate such order, directing that a religious procession shall not pass down a certain street. A knowingly disobeys the order, and thereby causes danger of riot. A has committed the offence defined in this section.
