ప్రభుత్వం తీసుకొచ్చిన ఉపాధ్యాయుల ఏకీకృత సర్వీస్‌ నిబంధనలను హైకోర్టు కొట్టివేసింది. పంచాయతీరాజ్‌, ప్రభుత్వ పాఠశాలల ఉపాధ్యాయులకు ఒకే సర్వీస్‌ నిబంధనలను వర్తింప జేస్తూ.. ప్రభుత్వం 2017లో తెచ్చిన రాష్ట్రపతి ఉత్తర్వులు చెల్లవని హైకోర్టు ఇవాళ తీర్పు ఇచ్చింది.
ఉపాధ్యాయుల ఏకీకృత నిబంధనలను సవాల్‌ చేస్తూ ప్రభుత్వ ఉపాధ్యాయుల సంఘం గతంలో హైకోర్టులో పిటిషన్‌ దాఖలు చేసింది. ప్రభుత్వ ఉపాధ్యాయులతో సమానంగా బదిలీలు, పదోన్నతులు, ఇతర ప్రయోజనాలు కల్పించాలని, ఉపాధ్యాయులందరికీ ఒకే సర్వీస్‌ నిబంధనలు అమలు చేయాలని పంచాయతీరాజ్‌ ఉపాధ్యాయులు చాలా కాలంగా ఆందళన చేస్తున్నారు. వారి డిమాండ్‌పై సానుకూలంగా స్పందించిన ప్రభుత్వం ఉపాధ్యాయులందరినీ ఒకే సర్వీస్‌ నిబంధనల కిందకు తెస్తూ.. గతేడాది జూన్‌ 23న రాష్ట్రపతి ఉత్తర్వులు తీసుకొచ్చింది.
ఈ ఉత్తర్వులను సవాల్‌ చేస్తూ ప్రభుత్వ ఉపాధ్యాయుల సంఘం హైకోర్టును ఆశ్రయించింది. ఉపాధ్యాయుల నియామకం సమయంలోనే పంచాయతీరాజ్‌, ప్రభుత్వ ఉపాధ్యాయులకు వేర్వేరు నిబంధనలు ఉంటాయని, లక్షల సంఖ్యలో ఉండే పంచాయతీరాజ్‌ ఉపాధ్యాయులను తమతో కలపటం ద్వారా తమ ప్రయోజనాలను దెబ్బతింటాయని ప్రభుత్వ ఉపాధ్యాయులు హైకోర్టుకు విన్నవించారు. ఇరు వార్గాల వాదనలను విన్న హైకోర్టు ప్రధాన న్యాయమూర్తి నేతృత్వంలోని డివిజన్‌ బెంచ్‌ ఇవాళ ఏకీకృత సర్వీస్‌ నిబంధనలను కొట్టి వేస్తూ తీర్పు ఇచ్చింది. దీంతో ఇకపై ఉపాధ్యాయుల బదిలీలు, పదోన్నతులు పంచాయతీరాజ్‌, ప్రభుత్వ ఉపాధ్యాయులకు వారి వారి నిబందనల మేరకే జరగనున్నాయి.

Final Words of the Judgement
  • In view of what is stated above, we are of the considered view that sub-paragraph (2A) inserted in paragraph-3 of the Presidential Order 1975 by GSR 639 (E) dated 23.06.2017 is ultra vires the power conferred by Clause (1) of Article 371D and beyond the purview of the different aspects indicated in sub-clauses (a) (b) and (c) of clause (2) of Article 371D of the constitution. Similarly, Entry 23A inserted in the Third Schedule to the Presidential Order, 1975 by GSR 637 (E) dated 23.06.2017, in as much as the same places Mandal Educational Officer, Headmaster and Headmistresses in Government and Zilla Parishad High Schools in the same class, is ultra vires Article 371D. While there is power conferred by Article 371D to organise any class or classes of posts, no power of integration or merger of cadres is expressly or impliedly conferred by Article 371D(1) of the Constitution. Hence W.P.Nos.23267 of 2017, and 27404 of 2017 are allowed and the impugned Presidential orders are set aside. W.P.No.23274 of 2017 is partly allowed, setting aside Entry 23A inserted in the Third Schedule to the Presidential Order, 1975. There shall be no order as
to costs.
