Medical Leave - Medical Certificate Which Doctor can Issue Clarifications FR 74

The Medical Certificate for Medical Leave of a Non Gazetted Government Servant (teachers also) can be issued by Registered Medical Practitioner. The Medical Leave application must be accompanied by a certificate from the applicants medical attendant who should be a registered medical practitioner. 


The Fundamental Rule FR 74 Annexure -II, Rule 16 is given below.
PROCEDURE IN THE CASE OF NON-GAZETTED GOVERNMENT SERVANTS IN SUPERIOR SERVICE
  1. 16. An application by a Non-Gazetted Government servant in superior service for leave, or for extension of leave on medical certificate must be accompanied by a certificate from the applicant's medical attendant who should be a registered medical practitioner. Such certificates should distinctly state the nature of the illness, its symptoms, probable causes and duration, the period of absence from duty considered to be absolutely necessary for the restoration of the applicant's health and the date from which such absence should take effect. The authority competent to grant the leave may in its discretion either accept the certificate or secure a second medical opinion by sending the applicant for medical examination either to a District Medical Officer or to the nearest Gazetted Government Medical Officer available.www.apteachers.in Should it decide to secure a second medical opinion, it must arrange for the medical examination to be made on the earliest possible date after the date on which the first medical opinion was given. It will be the duty of the District Medical Officer or the other Medical Officer, as the case may be, to make an independent examination of the applicant and on the basis of such examination to express an opinion both as regards the facts of the illness and as regards the amount of leave required.
  • Note 1:- The possession of a certificate as prescribed in this rule does not itself confer upon the Government servant concerned any right to leave.
  • Note 2:- The above procedure will not apply to Non-Gazetted Officers and subordinates of the Police Department in the twin cities. In their case the following procedure will apply:
  • (i) City Police personnel and other staff of the Police Department working in the twin cities be permitted to undergo treatment as inpatients or outpatients any of the Government Hospitals in the twin cities in-charge of Gazetted Medical Officers nearest and most accessible to them from the place of their residence it they are living in Police Lines or from the place of their duty if they are residing in private buildings, besides the Police Hospital at Malakpet; and
  • (ii) Certificates issued by the Registered Medical practitioners and countersigned by the Gazetted Officers incharge of the Government Hospitals nearest to them from the place of their residence, if they are living in Police lines or from the place of their duty if they are residing in private buildings, be accepted for the sanction of leave on Medical Certificates without the counter-signature of the Police surgeon.
  • (G.O.Ms.No.181, Finance, dated 29th May, 1971) 17. No certificate should be submitted for countersignature without the cognizance of the head of the office in which the applicant is serving.
  • 18. The countersigning officer may, in his discretion, require the applicant to appear before him, unless it appears from the certificate of his medical attendant that he is too ill to bear the journey. In the latter case the officer may, after careful investigation of the case, either countersign the certificate or refuse to do so, as he think fit.
From the above FR 74 related Annexure-II it is clear that Medical Certificates for Medical Leave can be issued by RMP Doctors in case of the Teachers, Employees of AP Telangana who are Non Govt Servants
