In the reference 2nd read above, an amendment to the Rule 28 of the Andhra Pradesh State & Subordinate Service Rules, 1996 was issued and by virtue of which the relinquishment of promotion by a member of service is confined to that panel year only and the member of service shall be considered for future vacancy for promotion, if otherwise eligible.

2. Subsequent to the issue of the aforementioned amendment, certain clarifications have been sought by the Administrative Departments.

3. In view of the above, the following clarifications are issued with reference to the relinquishment of rights for promotion in general & the G.O 2nd read above in particular:
  • (a) The orders issued in the G.O 2nd read above have prospective effect and the member of service who have relinquished his/her right of promotion, prior and subsequent to the issue of the G.O. in the reference 2nd read above, shall be considered for promotion, if otherwise eligible, from the panel year 2022-23 onwards.
  • (b) The relinquishment can be made only once during the panel year. Having once relinquished the promotion, the member of service shall not be considered for promotion again in the same panel year.
  • (c) There shall be no relinquishment of promotion, subsequent to the member of service joining the post to which he/she is promoted.
All the Administrative Departments and the competent authorities :quested to take necessary action in the matter accordingly.

Background
This circular provides clarifications on the amendment to Rule 28 of the Andhra Pradesh State and Subordinate Service Rules, 1996, which was previously modified through G.O.Ms.No.92 dated August 28, 2023. The amendment dealt with relinquishment of promotion rights by government employees.

Key Clarifications Issued
1. Retrospective Application (Most Significant)
The amended rules have prospective effect starting from panel year 2022-23 onwards. 

This means:
Employees who relinquished promotion rights either before or after the August 2023 G.O. will be reconsidered for future promotions
They remain eligible for promotion in subsequent years if otherwise qualified

2. One-Time Relinquishment Per Panel Year
An employee can relinquish promotion only once during a panel year
After relinquishing, they cannot be considered again for promotion within the same panel year
However, they can be considered in future panel years

3. No Relinquishment After Joining
Once an employee joins the promoted post, they cannot relinquish that promotion
Relinquishment is only possible before assuming the promoted position

Purpose
This clarification addresses queries raised by various Administrative Departments following the 2023 amendment, ensuring uniform implementation across all departments and service sections in Andhra Pradesh.
