ORDER:

The District Educational Officers and Additional Project Coordinators of Samagra Shiksha in the state are informed that the SMCs were reconstituted during September 2024.

As per the G.O.Ms. No. 19 School Education (Prog-1) Department dated 13.05.2025 of School Education - Re-structuring the schools run by State Government, Mandal Parishad, Zilla Parishad, Municipal and Tribal Welfare Departments schools from the Academic Year 2025-26 for optimal utilization of infrastructural and human resources some classes are merged in nearby schools and some schools are merged with the nearby schools.

In the new Academic year 2025-26, restructuring of schools and promotion of students to the next classes lead to the resultant cyclical and casual vacancies of SMCs in the schools.

All the DEOs and APCs are aware that as per the RTE Act, it is a regular activity of filling of vacant positions of SMC Members which is being done by the concerned Mandal and District level authorities as per the existing rules.

In view of this, some of the following RTE rules are given hereunder

As per AP RTE Rules amendment orders issued time to time and in GOMs.No.41 School Education (PE-SSA) Department dated 19.06.2013 and G.O.Ms.No.20 School Education (Prog-1) Department dated 13.05.2025.

As per amendment 4 in Rule 19.

(d) The School Management Committee once constituted shall exist perpetually until its abolition or merger, to be authorized by the Mandal Education Officer in case of Foundational/ Basic Primary School/Model Primary School Upper Primary School and the District Education Officer in case of other schools. However, members will retire as per their terms. The resultant cyclical and casual vacancies shall be filled within reasonable time as prescribed by the implementation Authority.

As per amendment for Sub rule 2(a)

(2) The term of an elected member will be for Two years, or the date of leaving from the school of the member's child/ward, whichever is earlier.

(3) New parent/guardian members from entry class will be inducted into the SMC to replace those parent members who will move out of the SMC when their children leave school

As per amendment for Sub rule 3

3. The School Management Committee shall elect the Chairperson and the Vice Chairperson from among its elected members. Provided that at least one of them should be a parent/guardian of a child from the disadvantaged group or the weaker sections. Provided further that at least one of them should be a woman."

As per amendment for Sub rule 4 in Rule 19

Electors of respective classes shall elect new parent/guardian members of SMC from entry class and also to fill in any casual vacancy.

As per RTE Rules 3(1)27

"The Implementing Authority of the Act" means State Project Director, Samagra Shiksha and it includes the Commissioner/ Spl. Commissioner/ Director of School Education, Andhra Pradesh.

In view of the above, the District Educational Officers and Additional Project Coordinators of Samagra Shiksha in the state are instructed to fill the resultant cyclical and casual vacancies of SMCs as per the rules for smooth functioning of the schools.
