AP High Court Orders Release of Pending Retirement Benefits to Employees Within 3 Months

పిటిషనర్లు ఆంధ్రప్రదేశ్ ప్రభుత్వంలో టీచర్లు మరియు ఇతర ఉద్యోగులుగా పనిచేసి రిటైర్ అయిన వారు.

రిటైర్మెంట్ తరువాత వారికి రావాల్సిన గ్రాట్యుటీ, Earned Leave encashment, Half Pay Leave, Surrender Leave, ZP Provident Fund మరియు PRC arrears ఇప్పటివరకు విడుదల కాలేదని కోర్టులో పిటిషన్ వేశారు.

సంబంధిత అధికారులు ఇప్పటికే బిల్లులను తయారు చేసి CFMS లో అప్లోడ్ చేసినప్పటికీ, ట్రెజరీ ద్వారా చెల్లింపులు విడుదల కాలేదని పిటిషనర్లు పేర్కొన్నారు.

దీనిని చట్ట విరుద్ధం మరియు అన్యాయంగా ప్రకటించి, తమ రిటైర్మెంట్ ప్రయోజనాలను 9% వడ్డీతో చెల్లించాలని పిటిషనర్లు కోర్టును కోరారు.

కోర్టు కేసు మెరిట్స్ లోకి లోతుగా వెళ్లకుండా పిటిషన్ను పరిష్కరించింది.

రెస్పాండెంట్స్ (ప్రభుత్వ అధికారులు) పిటిషనర్లకు రావాల్సిన రిటైర్మెంట్ బెనిఫిట్స్ను ఆర్డర్ కాపీ అందిన తేదీ నుండి 3 నెలల్లో పరిశీలించి విడుదల చేయాలని హైకోర్టు ఆదేశించింది.

కేసులో కోర్టు ఖర్చులు (costs) గురించి ప్రత్యేక ఆదేశం ఇవ్వలేదు.

పెండింగ్లో ఉన్న ఇతర పిటిషన్లు కూడా ఈ ఆర్డర్తో క్లోజ్ చేయబడ్డాయి.

రిటైర్ అయిన ప్రభుత్వ ఉద్యోగులకు ఇవ్వాల్సిన రిటైర్మెంట్ బెనిఫిట్స్ ఆలస్యం కావడంతో వారు హైకోర్టును ఆశ్రయించగా, కోర్టు ప్రభుత్వం 3 నెలల్లో ఆ బెనిఫిట్స్ విడుదల చేయాలని ఆదేశించింది.

The Writ Petition is field under Article 226 of Constitution of India for the following relief:
“ …to issue a Writ of Mandamus or any other appropriate writ, order, or direction declaring the inaction of the respondents in not releasing the retirement benefits i.e., Gratuity, Encashment of Earned Leave and Half Pay Leave, Surrender Leave, ZP Provident Fund, and PRC arrears to the petitioners in spite of their retirement as illegal, arbitrary, and unconstitutional, and consequently direct the respondents to release the retirement benefits i.e.. Gratuity, Encashment of Earned Leave and Half Pay Leave, Surrender Leave, ZP Provident Fund, and PRC arrears to the petitioners along with 9percent interest on the delayed retiremental benefits in terms of law laid down by the Hon'ble Apex Court reported in (2022) 4 SCC 627 and W.A.No.383 of 2022 dated 12.07.2022 to the petitioners from the date of entitlement till the date of payment, and pass …”
2. Heard learned counsel for the petitioner and Learned Assistant Government Pleader for respondents.

All the petitioners worked as teachers in Government of Andhra Pradesh and retired on attaining the age of superannuation and after retirement, the petitioners are entitled for gratuity, encashment of earned leave and half pay leave, surrender leave, ZP, provident fund and Pay Revision arrears. Basis on the entitlement, the authorities have prepared bills and submitted the same to the treasury department for payment of retiremental benefits and in fact, the bills were uploaded in CFMS on various dates but the reasons best know to them, the same are not being released to the petitioners. Hence, the present Writ Petition.
4. Considering the submissions made and on perusal of the record, without going into the merits, this Writ Petition is disposed of directing the respondents to consider and release the post retiremental benefits to the petitioners within a period of three (03) months from the date of receipt of a copy of this order.
