ఏడు సంవత్సరాలుగా ఆచూకీ తెలియని ఉద్యోగి కుటుంబ సభ్యులకు నియామకములు.
ఏడు సంవత్సరాలు వరుసగా ఆచూకి తెలియకుండా, జాడ తెలియని ప్రభుత్వ ఉద్యోగిపై ఆధారపడి జీవిస్తున్న కుటుంబ సభ్యులలో ఒకరికి కొన్ని షరతులకు లోబడి ప్రభుత్వ మెమో నెం. 60681/Ser.A/2003-1 తేదీ: 12-8-2003 
ఈ క్రింది నియమ నిబంధనలకు మేరకు కారుణ్య నియమకము కల్పించవచ్చు.
  • a) ఏడు సంవత్సరాల కాల వ్యవధిని కుటుంబ సభ్యులు పోలీసు స్టేషన్లో జాడ తెలియని విషయమై ఫిర్యాదు (FIR) చేసిన తేదీ నుండి లెక్కించవలసి ఉన్నది. పోలీసు శాఖవారు కనుమరుగైన ఉద్యోగి జాడ తెలియదని, నిర్ధారిత స్టడీకేట్ ఇవ్వవలసి ఉంది.
  • b) జాడ తెలియని ఉద్యోగి FIR నమోదు చేసిన తేదీ నుండి పదవీ విరమణ తేదీకి, ఇంకా ఏడు సంవత్సరాలకంటే తక్కువ సర్వీస్ ఉంటే పై ఉత్తర్వులు వర్తించవు.
  • c) ఉద్యోగము నిమిత్తము అర్హత గల కుటుంబ సభ్యుల నుండి, ఉద్యోగ జాడ తెలియని 7 సంవత్సరముల తరువాత, ఒక సంవత్సరము లోపల దరఖాస్తు చేసుకోవాలి.
  • d) ఉద్యోగ అవకాశము కల్పించు సమయములో లబ్దిదారు నుండి పూచి బాండ్, షరతులు విధిస్తూ , అనగా ఒకవేళ జాడ తెలియని ఉద్యోగి తిరిగి వచ్చినా, లేక జీవించే ఉన్నాడని తెలిసినా, లబ్దిదారుడిని ఉద్యోగం నుండి తొలగించుటకు తదితరములు తెలియజేస్తూ పొందవలసి ఉన్నది.
  • e) జాడ తెలియని ప్రభుత్వ ఉద్యోగిపై ఆధారపడి జీవిస్తున్న కుటుంబ సభ్యులలో ఒకరికి కారుణ్య నియమకము కొరకు ప్రభుత్వ ఉత్తర్వులు G.O.Ms.No.378 GA (Ser-A) department తేదీ : 24-08-1999 మరియు ప్రభుత్వ మెమో నెం. 60681/Ser.A/2003-1 తేదీ: 12-8-2003 నందు జారీచేసిన ఉత్తర్వులను విధిగా పాటించవలసి ఉన్నది.
(a) A request for grant of the benefit of compassionate appointments can be considered only after a lapse of 7 (seven) years from the date from which the Government servant has been missing, provided that:
  • (i) An FIR (First Information Report) to this effect has been lodged with the police:
  • (ii) The police report shall certify that the missing Government employee is not traceable: and
  • (iii) the competent authority feels that the case is genuine:
(b) This benefit shall not be applicable to the case of a Government servant:-
  • (i) Who had less than 7 (seven) years to retire on the date from which the FIR is filed: and/ or
  • (ii) who is suspected to have committed framed or suspected to have joined any terrorist/extremist organisation or suspected to have gone abroad.
(c) While considering the request for compassionate appointment the result of the police investigation shall also be taken into account:
(d) Applications for compassionate appointment from the dependents of such missing Government employees shall be entertained within a period of one year from the date of completion of 7 (Seven) years from the date of filing FIR with police.

(e) A decision on any such request for compassionate appointment shall be taken only at the level of the Secretary to Government of the respective administrative Department concerned and only after receipt of the approval from the concerned Secretary to Government, the respective appointing authorities shall issue necessary orders to appoint the eligible dependent of such missing Government employee as per the existing instructions on the scheme of compassionate appointments to the dependents of deceased Government employees in addition to the above conditions, if there is a vacancy readily available in the department.

(f) A bond shall be obtained from the dependent of such missing Government employee, whose whereabouts are not known for more than 7 (seven) years that in the event of appearance of such missing Government employee at a later date or proved that such missing Government employee is alive anywhere, the services of the persons so appointed are liable for termination

    My name is amujuri durgaram . My father name A. Sanyasi rao he is
    working in Port dept employee lascar, but he is missing in march-04-2009 still not traced and more than 12 years completed sir, madam.

    I have depended my family thats why Iam apply so many times compassionate appointment but not accept ap govt rule position GO 378.
    1.who had less than 7years to retire on the date from which the fir s filed.
    2. but my father missng date to retirement time is 4years 6months times there only.

    I have police station certificate, court death jourgement and more office copies but no use.
    Please sir, madam once try to understand my position and give me any chance or information about my case.
    I requesting need to compassionate appointment sir, madam.

      28) For the above mentioned reasons, in the considered
      opinion of this Court, the condition No.3(b)(i) of the
      G.O.Ms.No.378, GA (Ser-A) Dept., dated 24.08.1999, in
      which it is provided that the missing Government servant
      shall have 7 years of service to retire on the date from
      which the FIR is filed is discriminatory, arbitrary, unjust and
      violative of Article 14 and 21 of the Constitution of India
      and is liable to be struck down.
      29) Accordingly, Writ Petition is allowed with the following
      directions:
      i) The condition No.3 (b) (i) of G.O.Ms.No.378, GA
      (Ser-A), Department, dated 24.08.1999, is hereby struck
      down;

      ii) The Memo No.JS(Per)/DS(E)/AS (V&R)-NT/PO 1/718/ 2004, dated 03.03.2009, is set aside;
      iii) The respondents are directed to consider the case
      of the petitioner for appointment on compassionate grounds
      in terms of G.O.Ms.No.378, GA (Ser-A) Department, dated
      24.08.1999 in any suitable post within a period of Six (6)
      weeks from the date of receipt of a copy of this Order; and
      iv) There is no order as to costs.
      Consequently, miscellaneous applications pending, if
      any, shall stand closed.
