    Government also decided to prescribe the following SOP for the purpose of issuing community certificates on a permanent basis in respect of (21) Castes / Communities concerned that are mentioned in the table at Annexure-A in the Districts other than Districts to which they are Geographically Restricted hitherto, consequent upon removal of Area / Geographical restrictions existing on them, so as to protect the interest of the genuine claimants and also to avoid the likely misuse through false claims.

    ORDER:

    In the G.O. 1st read above, the Government have notified the list of Backward Classes (other than the Scheduled Castes and the Scheduled Tribes) and declared that the Castes and Communities specified in Annexure-I to the said order are Socially and Educationally Backward Classes for the purposes of Reservation provided under Article 15 (4) and 16 (4) of the Constitution of India. At the outset, there were 93 Castes / Communities alone in the list of Backward Classes.

    2. Based on the demands of various Caste Associations and recommendations of the A.P. Commission for Backward Classes, certain castes came to be included in the list by the Government from time to time and accordingly necessary Amendments were also made in various orders and updated the Annexure-I to the reference 1st read above. As a result, the number of castes included in the list of Backward Classes had gone up to 139. Later on, it has come down to 138 due to the recent change made through G.O.Ms.No.9, Backward Classes Welfare (F) Department, Dt. 20.04.2023 in respect of 'Kandra' Caste, which listed at Sl.No.11 under Group-D has been brought to Sl.No.1 under Group-A.

    3. Out of 138 castes figuring in the list of Backward Classes, 31 castes have Area / Geographical Restrictions on their operation. Out of 31 castes, 10 belong to Telangana Region (now Telangana State) and the remaining 21 have their existence in the present Andhra Pradesh State comprising Coastal Andhra and Rayalaseema Regions.

    4. In the references 2nd to 26th read above, the (21) BC communities that have Area / Geographical Restrictions on their area of operation were mentioned and the same are stated in detail in Annexure-A to this order.

    5. In the reference 27th and 28th read above, the A.P. State Commission for Backward Classes, Vijayawada in its reports recommended to the Government to consider removal of Area / Geographical Restrictions existing in respect of certain BC Communities in the list of Backward Classes based on the representations / requests of Caste Associations / individuals submitted directly to the Commission or through the Government for removal of Area / Geographical Restrictions.

    6. The Government, based on the recommendations of the A.P. State Commission for Backward Classes, Vijayawada, consulted the Revenue Department and Law Department in this regard. After careful examination of the entire matter in its holistic manner, Government hereby decided to remove the existing Area / Geographical Restrictions in respect of all (21) Backward Class Communities thereby extending the benefit of reservation to all of them throughout the State of Andhra Pradesh except 'Settibalija,' listed at Sl.No.4 under Group-B and whose traditional occupation is toddy tapping (kallu geetha), which is not extended to Greater Rayalaseema Districts.

    7. Further, the Government also decided to prescribe the following SOP for the purpose of issuing community certificates on a permanent basis in respect of (21) Castes / Communities concerned that are mentioned in the table at Annexure-A in the Districts other than Districts to which they are Geographically Restricted hitherto, consequent upon removal of Area / Geographical restrictions existing on them, so as to protect the interest of the genuine claimants and also to avoid the likely misuse through false claims.
    • a. The powers to issue community certificates to the said (21) castes are entrusted exclusively to the District Collectors. However, the proposals shall be initiated by the Tahsildars and routed through the Revenue Divisional Officers concerned.
    • b. The claims shall be thoroughly and scrupulously verified by the authorities to establish their genuineness as per the provisions prescribed under the Andhra Pradesh (Scheduled Castes, Scheduled Tribes and Backward Classes) Regulation of Issue of Community Certificates Act, 1993 (Act No.16 of 1993) and rules as contained as contained in G.O.Ms.No.58, Social Welfare (3) Dept., Dt.12.05.1997.
    • c. Necessary enquiry by the authorities shall be conducted into the origin and existence of the claimants in Districts other than the geographically restricted Districts (on migration from restricted Districts or otherwise).
    • d. The District B.C. Welfare & Empowerment Officers shall extend necessary assistance and provide relevant information about the ethnographic profiles of the castes concerned.
    • e. The District Collectors shall take the required precautionary measures and issue suitable instructions to all the authorities concerned to take meticulous care in processing the claims for issuance of community certificates to the said (21) communities.
    • f. The GSWS Department shall make necessary modification in AP SEVA Portal to process the applications seeking caste / community certificates of 21 castes / communities concerned accordingly.
    8. It shall be ensured that only the genuine claimants will get the benefit out of this measure of Removal of Area / Geographical Restrictions, without defeating its very purpose. The false claims made with a malafide intention shall be curbed effectively and they shall be dealt with sternly with stringent punitive action.

    9. The General Administration (Services-D) Department shall take necessary action to amend the Rule-22 or relevant rules of A.P.State and Subordinate Service Rules accordingly.

    10. The Chief Commissioner of Land Administration, A.P., Mangalagiri / the Director, GSWS Department, A.P., Vijayawada the Director, Backward Classes Welfare, A.P., Vijayawada and all the District Collectors in the State are also hereby directed to take necessary action accordingly.
